Andrea Št'astková for EPRAVO.CZ on the prohibition of surprise decisions in arbitration proceedings
The Supreme Court of the Czech Republic recently ruled that the principle of prohibition of surprise decisions applies not only in civil proceedings, but also in arbitration proceedings. This judgment confirmed the importance of the predictability of arbitrators' decisions, despite the specific nature of arbitration proceedings, in which different principles apply to a large extent than in civil proceedings. Interestingly, the Supreme Court did not limit itself to referring to its previous decisions in the reasoning of the decision, but also made a comparison of the Czech approach with foreign legal systems.
The Supreme Court's decision thus confirmed the limits of arbitration proceedings arising from the right to judicial protection enshrined in the Charter of Fundamental Rights and Freedoms.
