Key Changes to Family Law Effective from 1 January 2026

As of 1 January 2026, family law has undergone a significant amendment, changing the way courts approach divorce proceedings as well as decisions on the care of children.

The new legal framework places greater emphasis on agreements between parents, efforts to resolve family disputes more quickly, and the strengthening of the equal position of both parents in decision-making concerning children.

Attorney Markéta Tkadlecová has examined the new legal framework in detail and prepared an overview of the points that are expected to have the greatest practical impact. A concise and practice-oriented summary of the individual changes is available on her LinkedIn profile, where she highlights in particular the areas in which a change to established court practice can be expected.

How the amendment will be reflected in the everyday decision-making of the courts will become clear over time. Initial observations from practice, however, suggest that the new regulation is still finding its place in the decision-making process and that its actual impact will develop gradually.
