Custody proceedings with an international element often raise complex procedural and legal issues. A single case may be subject to several different sets of laws, and the court must first determine whether it has international jurisdiction and under which law it will render its decision.
During a seminar organised by the Judicial Academy for judges, our partner Marta Zavadilová addressed this very topic.
The seminar primarily focused on practical procedures for handling custody proceedings with a cross-border element, as well as issues related to the application of foreign law in the Czech context. Specific examples of differences between various legal systems were also discussed, such as situations where a foreign legal system automatically places young children in the mother’s custody.
Marta has specialised in private international law, family law, and cases with international implications throughout her professional career. At the seminar, she shared her professional experience and discussed the practical challenges that such proceedings present with the judges.
