The legal journal EPRAVO.CZ MAGAZINE has published an article by Petr Bříza, a partner of our Czech law firm, about the enforcement of foreign arbitral awards in the light of a problematic decision of the Czech Supreme Court.

The decision addresses the question of whether an arbitration award falling within the scope of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention) may be enforced by means of execution by an executor, without having undergone special proceedings for the recognition of the award. The Supreme Court's opinion tends to reject such a possibility and thereby in Petr’s view creates an unnecessary obstacle to enforcement of foreign arbitral awards.
