Radka Čihulková for EPRAVO.CZ on the right of putative fathers to deny the paternity of the legal father

The case law of the Supreme Court, the Constitutional Court, and the European Court of Human Rights suggests that in certain cases, the biological father should be granted the right to deny the paternity of the legal father. However, the current legislation in the Czech Republic is the most restrictive of all European Union countries in terms of active legal standing to deny paternity and does not enshrine the right of the biological father to deny the paternity of the man who is registered as the child's father in the birth register. Do courts therefore have contra legem active legal standing to grant this right to the biological father? And if so, under what conditions?
