Petr Bříza for Seznam Zprávy on the completion of Dukovany and the Hungarian Paks II power plants
The Austrian government has once again expressed its concerns regarding the construction of new units at Dukovany, and has formally submitted its objections to the European Commission. According to our partner Petr Bříza, whom Seznam Zprávy approached as an expert on European law, these letters are primarily political in nature.
In contrast, the recent ruling by the Court of Justice of the EU in relation to the Hungarian Paks II power plant has a significant legal implications. As Petr Bříza emphasises: "Until the European Commission issues a new decision approving state aid for Paks II, Hungary may not implement the aid under Article 108(3) of the Treaty on the Functioning of the EU. Any financing without EU approval would constitute illegal state aid."
