Radka Čihulková and Tereza Heinrichová for EPRAVO.CZ: How the Lugovoy Law changes the rules of international arbitration

Until recently, if the parties had agreed on an arbitration clause, their dispute would be resolved by the chosen arbitral tribunal. However, in disputes involving Russian entities, this certainty is significantly diminished.

In a new article published on EPRAVO.CZ, trainee attorney Radka Čihulková and paralegal Tereza Heinrichová address the so-called Lugovoy Law — Russian legislation which allows Russian courts to assume exclusive jurisdiction despite the existence of an arbitration clause or a choice-of-court agreement.

In the article, the authors explain the main mechanisms of this legislation, the development of Russian courts’ case law and the reactions of foreign courts. They also consider its potential impact on international investment arbitration and the legal certainty of contracting parties.
