Until recently, the general rule was that disputes between parties who had agreed to an arbitration clause were to be resolved by the chosen arbitral tribunal. However, in disputes involving Russian entities, this certainty is significantly diminished.
In a new article published on EPRAVO.CZ, trainee attorney Radka Čihulková and paralegal Tereza Heinrichová discuss the so-called Lugovoy Law — a Russian legal provision that allows Russian courts to assume exclusive jurisdiction despite the existence of an arbitration clause or a choice-of-court agreement.
In the article, the authors explain the main mechanisms of this legislation, the evolution of Russian court case law and how foreign courts have reacted to it. They also consider the potential impact of the Lugovoy Law on international investment arbitration and the legal certainty of the contracting parties.
